Privacy Policy

1. About this policy

We respect your privacy. We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. This policy explains what we collect, why, how we protect it, and how you can access or correct it. If you give us information about someone else, please make sure they have agreed, particularly for sensitive information.

2. What “personal information” means

Information or an opinion about an identified individual, or an individual who is reasonably identifiable.

3. What we collect

  • Clients and their representatives: name, job title, contact details, communications, financial information and legal interests. Sensitive information where relevant to a matter, such as health information, union membership, religious beliefs or criminal records.
  • Job applicants, contractors and suppliers: contact details, CV, education and employment history, interview and assessment notes, contract performance and bank details for payment. Sometimes sensitive information, such as a criminal record check.
  • Website users, subscribers and event guests: name, contact details, employer, job title and areas of interest; dietary needs for events; business card and social media details.
  • Alumni: contact details, gender, and current and previous employment.
  • Others connected with a matter: names, contact details, job titles and communications of other parties, their representatives and service providers.
  • People making requests of us: name, contact details and identity verification, for example from government, regulators or media.

4. How we collect it

Usually directly from you or your organisation. Sometimes from others, including clients, government and law enforcement agencies, public registers, courts and tribunals, regulators, ratings and search agencies, service providers, referees, former employers, recruitment agencies, and online and social media searches.

5. How we keep it secure

  • Paper files are held in access-controlled offices and locked storage, and offsite with providers that use CCTV and controlled access.
  • Electronic records are held on secure, password-protected systems, including trusted third-party providers who must protect them against unauthorised access, loss or damage.

6. How we use and share it

  • To provide legal services and manage our client relationships
  • To engage others on your matter, such as barristers, accountants, mediators and valuers, and our own IT, marketing and recruitment providers
  • For research, planning and risk management
  • To send publications and updates and to run events
  • To assess job and contractor applications, and manage staff and suppliers
  • For insurance, regulatory searches and to meet our legal obligations

7. Marketing emails

We may send you legal updates, publications and event invitations. Our email system records whether emails are opened and links clicked, so we can keep content relevant and our lists accurate. You can unsubscribe at any time using the link in any email or by contacting our Privacy Officer.

8. Sharing information overseas

  • Some service providers, including in England, Hong Kong, the United Arab Emirates and the United States (including Google, which provides our website analytics), may store or process information for us.
  • For job applicants with overseas experience, we may contact overseas referees.
  • In client matters, information may go overseas depending on the matter, so we cannot list every country in advance.
  • With your consent, we may share your contact details with overseas legal directories and awards.

9. Cookies and website analytics

Our website uses cookies to work properly and to help us understand how visitors use it. We use Google Analytics to collect information about how visitors use our website, such as the pages visited, time spent on the site, the type of device and browser used, and the general location (city or region) from which the site is accessed. Google Analytics does not give us your name or contact details, and we do not use it to identify individual visitors. This information may be stored and processed by Google outside Australia, including in the United States. You can block or delete cookies through your browser settings, or opt out of Google Analytics using Google’s opt-out browser add-on. Blocking cookies will not affect your ability to use our website.

10. Access and correction

You can ask to see the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. We will respond within a reasonable time. We may charge a reasonable fee for access, or refuse access where the Privacy Act allows; if so, we will explain why.

11. Complaints

If you think we have breached the Australian Privacy Principles, please contact our Privacy Officer. We aim to respond within 30 days. If you are not satisfied, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992.
